These Terms & Conditions apply to all kinesiology sessions, courses, workshops, digital products, and physical products offered by Empowered State Kinesiology.

By using this website, booking a service, enrolling in a course, or purchasing a product, you acknowledge that you have read and agree to these Terms & Conditions.

Note: This page provides general conditions of service and sale and is not legal advice. For legal advice, please consult a qualified Australian lawyer.

1. GENERAL WEBSITE TERMS

• Empowered State Kinesiology provides holistic services, education and wellbeing products.

• We may update or change these Terms & Conditions at any time.

• Continued use of this website indicates acceptance of the updated terms.

• All prices are listed in AUD.

2. KINESIOLOGY SESSIONS – TERMS & CONDITIONS

These terms apply to all in-person and online kinesiology sessions.

2.1 Nature of Services

• Kinesiology is a complementary wellbeing modality and does not diagnose, treat or cure medical or psychological conditions.

• Nothing provided in sessions or on this website is intended to replace medical, psychological or veterinary care.

• Clients should seek appropriate professional care where needed.

2.2 Client Responsibility

By booking a session, clients agree to:

• Take responsibility for their own wellbeing during and after the session.

• Disclose relevant health information.

• Understand that individual outcomes vary.

• Participate voluntarily and accept any associated risks.

2.3 Confidentiality

• All information shared during sessions is confidential.

• Information may only be disclosed where required by law or where there is risk of harm.

2.4 Working with Minors

• Clients under 16 years must have a parent or guardian present for the entire session.

• Written consent is required for each session.

2.5 Payments & Cancellations

• Payment is required at the time of booking unless otherwise arranged.

• 24 hours notice is required for cancellations.

• Late cancellations or no-shows may be charged the full session fee.

• Late arrivals may result in a shorter session without fee reduction.

3. COURSE & WORKSHOP ENROLMENT TERMS

The following terms apply to all EMK courses and workshops offered by Empowered State Kinesiology.

3.1 Enrolment & Payment

• Enrolment in any course or workshop is subject to availability and receipt of payment.

• Multi-day courses generally require a $250 non-refundable deposit to secure a provisional place, unless otherwise stated. Participants may alternatively elect to pay the full course fee at the time of enrolment.

• Where Direct Bank Transfer is selected, enrolment is not confirmed until payment has been received and cleared in full. Selecting a payment method or submitting checkout details does not reserve a place.

• Where a deposit payment is made, the remaining balance must be paid no later than 21 days prior to course commencement. It is the participant’s responsibility to return to the website and complete payment by the due date. No reminders or follow-up invoices will be issued.

• Failure to pay the remaining balance by the required date may result in cancellation of enrolment and forfeiture of the deposit, and the place may be offered to another participant.

3.2 Student Cancellations

• All deposits are strictly non-refundable.

• Where cancellation is requested more than 21 days prior to course commencement, a one-time transfer to the next available intake may be requested, subject to availability.

• Cancellations made within 21 days of course commencement are not eligible for refunds or transfers.

• No refunds, credits, or transfers are provided for non-attendance, late arrival, early departure, or failure to complete course requirements.

3.3 Cancellations or Changes by Empowered State Kinesiology

• Empowered State Kinesiology reserves the right to cancel or reschedule a course or workshop due to illness, emergency, low enrolments, venue unavailability, or safety considerations.

• In such cases, participants will be offered the choice of a full refund or a transfer to the next available intake.

• Empowered State Kinesiology is not responsible for any additional costs incurred by participants, including but not limited to travel, accommodation, childcare, or loss of income.

3.4 Attendance & Certification Requirements

• Full attendance of all scheduled training hours is required in order to receive course certificates and allocated proficiency or continuing education hours.

• Failure to attend all required hours may result in forfeiture of certification for that intake, at the discretion of the instructor. Partial attendance does not guarantee certification or credit.

3.5 Behaviour, Conduct & Safety

• Participants are expected to behave respectfully, maintain confidentiality, and uphold the integrity of the learning environment.

• Empowered State Kinesiology reserves the right to remove any participant whose behaviour is disruptive, inappropriate, unsafe, or in breach of professional or ethical standards. Removal under these circumstances does not entitle the participant to a refund or credit.

3.6 Intellectual Property & Use of Materials

All course materials, manuals, handouts, recordings, and resources are protected by copyright and remain the intellectual property of Empowered State Kinesiology and associated EMK licensors.

Course materials may not be copied, reproduced, shared, distributed, recorded, or used for teaching or commercial purposes without prior written permission.

Completion of a course does not grant permission to teach, facilitate, or reproduce EMK materials or techniques beyond personal or professional development within scope.

3.7 Scope of Practice & Disclaimer (IICT-Aligned)

EMK courses and workshops are educational in nature and are intended for personal and professional development.

They do not constitute medical, psychological, psychiatric, or health advice, and are not a substitute for diagnosis or treatment by a qualified medical or allied health professional.

Participants acknowledge that Emotional and Metaphysical Kinesiology operates within a complementary health framework. Any application of techniques learned is undertaken at the participant’s own discretion and responsibility.

Empowered State Kinesiology makes no guarantees regarding outcomes, results, or future professional accreditation beyond what is explicitly stated.

3.8 Media, Photography & Recording

Short photographs or video recordings may be taken during courses or workshops for promotional or educational purposes.

Participants may opt out by notifying the instructor prior to course commencement. Opting out will not affect participation or certification.

Unauthorised recording of course content by participants is not permitted.

These terms apply to all EMK courses and workshops.

4. PRODUCT SALES – TERMS & CONDITIONS

These terms apply to all physical and digital products sold through the Empowered State Kinesiology website.

4.1 Orders & Payment

• Payment is required at checkout.

• Prices may change at any time.

• Orders may be cancelled if fraud is suspected or stock is unavailable.

4.2 Shipping & Delivery

• Orders are typically dispatched within 2–5 business days.

• Delivery timeframes vary based on the carrier.

• Once shipped, risk passes to the customer.

• Additional postage may be required if an incorrect address is provided or if the parcel is not collected.

4.3 Returns & Refunds

The following items cannot be returned or refunded:

• Essential oils

• Sprays and mists

• Crystals and ritual tools

• Opened or used items

• Digital products

Change-of-mind returns are not accepted.

Faulty or Incorrect Items

• If a product arrives damaged or incorrect, contact us within 48 hours with photos.

• If assessed as faulty, a replacement, store credit or refund will be offered in accordance with Australian Consumer Law.

4.4 Digital Products

• All digital product sales are final.

• Digital products may not be copied, shared or resold.

• Customers are responsible for downloading and storing their files.

4.5 Product Safety

• All products are for external or energetic use only.

• Always check for allergies or sensitivities.

• Keep products out of reach of children and pets.

• Products are not intended to diagnose or treat any condition.

5. PRIVACY POLICY

Empowered State Kinesiology complies with the Australian Privacy Principles.

We collect personal information to:

• Manage bookings and payments

• Administer courses

• Process orders

• Communicate important updates

Your data is never sold. It is only shared where legally required or necessary for payment processing or shipping.

6. LIMITATION OF LIABILITY

To the extent permitted by Australian law:

• Empowered State Kinesiology is not liable for injury, loss, emotional responses or decisions arising from kinesiology sessions, courses, products or digital content.

• These Terms do not exclude mandatory guarantees under Australian Consumer Law.

7. GOVERNING LAW

These Terms & Conditions are governed by the laws of Victoria, Australia.
Any disputes will be resolved through the courts of Victoria.
